With claims of mod abuse posted multiple times a week, I'd like to provide a method for people to legitimately express their concerns without cluttering the forums and to examine those claims in a fair and unbiased fashion.
Logistics
.
To suggest a case to be heard, post in this topic or PM to me the name of the mod in question along with a short synopsis of the supposed abuse.
If I decide to hear an case, I will select 5 jury members by interviewing those who have previously volunteered. Jury members will be selected on the basis of being unbiased and creating a diverse overall jury. Jurors remain anonymous until after the case's conclusion and are removed and replaced if they reveal their juror status before then.
With a 5-member jury constructed, I will publicly announce the case here and privately contact the plaintiff and defendant. Each must nominate someone to represent them as an attorney, and (while not advised) they are allowed to nominate themselves. There are no rules as to who may be nominated as an attorney and even an undisclosed alt may be chosen.
With attorneys chosen, I will designate a 24 hour deadline by which the plaintiff must submit their statement to this topic. The defendant will have exactly 24 hours after the submission of the plaintiff's to submit their own statement. Failure to submit a statement by the deadline for either side results in the jury not considering that side's statement.
After the defense posts their statement, the jury will deliberate privately, PMing me their votes within 24 hours. Jury members may not abstain from voting, and failure to send me a vote will be counted as a vote for innocent.
The result of whether the mod has been found guilty or innocent of mod abuse will be posted here and submitted to the admin(s). Failure by the admin(s) to punish a mod in the case of a guilty verdict will likely result in a community riot and angry emails to Lucid, which has precedence for being effective.
Other details:
There is no double jeopardy and there is no higher court to appeal to, meaning all decisions are final.
Mods and admins cannot be jury members.
If I am unable to construct a 5-member jury, I will construct a 3-member jury instead and replace the missing two members with innocent votes.
As always, and jury members will be continuously informed of this, the defense is considered innocent until proven guilty. I hope the logistics of this court demonstrate this philosophy as well.
Potential jury members will not know what the case is about during their interviews.
If Lucid were to accept that settlement agreement then there would be no need for a trial.
The trial exists because Lucid has not accepted the agreement. In the event that Lucid is found liable, I will present to him what feel is just compensation for his liability. The plaintiff does not decide the compensation.
"The Plaintiff alleges civil negligence against Wang for failure to appoin tnew administrators in a timely manner. This act of negligence has caused and is continuingto cause significant non-economic loss to the entire Epicmafia community."
There's no way to avoid bias when the defendant is the site owner, and we only have 5 jury volunteers anyway.
modify your agreement to not give admin powers to the people you mentioned. If anything we should get to vote on the admins.
whitepimp and charley will kill this website
As the judge I will ensure that the final settlement is fair, i.e. I will request that Lucid decides an admin within a set time frame and he will not be required to pick anyone in particular.
Read Lai's actual document. He says that they need to place in power whitepimp/charley. What if you put in like a committee to pick of people to appoint an admin like a commitee of Linker, Brownpimp and Ponylove
As the judge I decide the final settlement, and I can tell you that the final settlement will not select or promote any particular users for admin.

Even if we get an attorney to represent Lucid, we can't try him in absentia unless you can provide acceptable proof that he was served a legal notice and chose not to defend himself.

Does Mt01 think this is real lol
this should be real. there should be a trial by jury option for everyone. I like this idea. Like if there is a report you do not like, you can appeal by trial by jury...

dont u bias test ur jury?
problem is there is no like governing document saying what is allowed or not. I am not sure that Lai can pick the admins like this!
do people really want no vio pimp and Charley? RIP EM IF SO
In the absence of more than five jury volunteers and with the defendant being the owner of the site, I deem Betrayal, Shwartz99, Marco, mt01, and illuminati to be fit jury members who will not be kept anonymous for this particular case.
Lailai, you may PM me the attorney you wish to represent you, and Lucid, since I know you won't reply I am opening up his attorney position to volunteers. It is first-come, first-served.
